sir, have a pleasant dat to you. i have some question in regards of the employment here n qatar, perhaps you are aware for this kind of problem. we are working in 7 days a week without pay any extra or means OVER TIME PAY since we came here in qatar. as the law said that they must pay the over time if they employee will on duty but the problem they told that that's indicated in the FIX OVER TIME.the contract is not very specific well so that we want to ask you about this...... if we complain to the ministry directly our employer will be cancel as and they will put a termination to our employment.. sir please advice me for what we should do about our employment.. you will be more help for the people suffer for the wrong system. hope to hear some answer from you as soon as possible. thank you and more power.....

first of all, the problem is that people accept jobs with employers without having a clear contract in the first place. Ask for clarity in writing as to what the contract means and then go ahead and take it from there.

good day! im from philippines i worked in qatar april 2009 i just got home last year july2010 i didnt finish my 2years contract bcoz of reasons regarding the company policies which they not follow qatar labor law.. but i would like to come back qatar bcoz my sister is offering me a job at where she works for 2years now.. i really like to work with her bcoz her company good not like my company before.. but sadly they didnt give me COE and NOC can i still work in qatar if i didnt have those paper? what should i do? how can i get NOC from my company before? i really would like to know bcoz i want to work again this year hopefully.. please help me can i have another choice to work in qatar? bcoz i cant wait for 2years.. thank you...

at the moment, you need an NOC or can't come back to work for 2 years. You have to get it from your company if you want to come back.

Dear Sir, I am only new to this site, first I would like to thank you already if you be able to answer some of my questions. I came here in Qatar as a Tourist Visa who applied for a work that most of the tourist visa like me is doing just trying to find good fortune in this country. I got a job and i have already given my NOC from travel agency to the company where i am working now for almost 1 month. My tourist visa has expired last January 27. I am working now to this company but I never signed any contract as to date. I have got another offer from other company and they are giving more better salary than the one I have now. I have spoken to the company's PRO and she informed that they already process my visa, but until now I did not had my finger printing and Medical and I did not signed any contract at all. My question is can I still transfer to another job? What if my company now will not going to issue an NOC how can I transfer to another company? and if they will cancel me should they send me back to my home country and I will be having a ban. Hope you can help me with matter that really bother me a lot. Thank you in advance

if you didn't sign a contract then they couldn't have processed the visa. One of the visa requirements is to show the contract. No contract or business visa means 1) You are not tied to the company 2) You have been working here so far illegally.

Thank you so much Sir for the advice. But why the PRO is telling me that they already process my visa because I also follow up to them that my tourist visa is already expired and she informed me that I should not worry because my visa is already in their company's name. That's also I am thinking that how they process the visa without any contract. Just in case i will ask my company now that i want to transfer to other company, and they will not allow me because they already issue the visa to me, if they really did! do i have the right to transfer to other company without any ban? and what if they will not issue NOC? Again Sir a Million Thanks to You.

Hello Mr. Amnesia.. I hope everything is fine with you & to your family... I have many questions in my mind that I think only you can answer & I believe most. I would like to start my long story & I hope you are interested. First of all I hired from Dubai but immediately my company sent me here since we are starting & building our company here in Qatar. Since we are only Subcontractor, the first time I land here in Qatar I was then under the sponsorship of our Main Contractor which I stayed with them under their sponsorship for almost 3 years. I've been staying here for almost 4 years. Now we have a local sponsor here which I am under their sponsorship for almost a year. As time goes by, I found my company inefficient. I know before I joined with them I have a contract signed. And it is my mistake. As for my experience, I found the following problems with my company: 1. In my contract(Company Letter of Agreement) we should work 10 hours per day, no overtime.. Friday Off. 2. When there is overtime, there is no additional multiplier. I mean multiply by 1 only which is in general, It should be 1.25 or depend on the kindness of the company. 3. For my working years in my company, I received only my gratuity started 1.5 years ago which is before that I did not received any single riyals from them. 3. There is company rule that when you resigned you should give notice at least 3 months. And I think when you apply with other company, no company will wait you for such long resignation noticed. Since I'm working here in Qatar, I'm holding a Employment Contract with our local sponsor as a formality & my company Letter of Agreement, Do I have the right to present my Letter of Agreement If ever I will complain to the Labor Department since my Employment Contract from my Local sponsor has many conflicts with my Company Letter of Agreement as per Qatar Labor Law since I'm working here? As brief summary, my Employment contract here in Qatar(Formality) contain as follows: 1. 8 hours working per day. Friday Off. 2. Yearly gratuity. 3. 1 month notice if I resign. This Employment Contract has been effectived last June 2010 due to the transferring of my Visa to my Local Sponsor. Which is originally I stayed here for almost 4 years. Recently I applied a job and I passed the interview. The Company that I applied is from Dubai also and they want to establish their company here in Qatar. My prospective new employer wants me to reside here since they have already a Local sponsor. When I approached my Boss about this matters that I am asking for an NOC he refuse to give me NOC. As he said this is a company rule. In addition, he told me just in case I will resign, I will give them a 3 months notice as a company rule. Now, I need you help Mr. Amnesia. 1. If my company will refuse to give an NOC, do I have the right to complain in Labor Department? Since I'm staying here for almost 4 years. 2. Can I complain here for my gratuity even if I'm originally hired from Dubai? 3. If my Boss insist the 3 months notice resignation and I submit only 1 month as a Qatar Labor Law and my Boss insist again the 3 months notice, do I have the right to complain in Labor Department? 4. If I am going to let to finished my Visa by end of this coming May 2011, do I have the chance to get an NOC? If my company refused, can ask for help to Labor Department? Good afternoon There continues to be a lot of talk (rumour) about proposed changes in the country's Labour Law - specifically the rules governing realease from Qatari companies and the issuance of NOC's. Could you please advise what is your understanding of the progress that is being made currently by the Government in this respect?? Many thanks

Hello, I am seeking advice regarding a transfer or change of sponsorship. I am currently female on a single sponsorship which was provided by my employer. My husband is now also sponsored and I would like to change my sponsorship to be under his family/spousal sponsorship. How can I go about changing my sponsorship? Is my employer likely to allow this? I have been with my employer for less than a year. If I am able to change my sponsorship, given I am provided a letter of permission by my new sponsor (my husband's sponsor) and register as a working woman, will I be able to continue to work in Qatar? Hi there, Persona, you have to remember that there is a difference between sponsorship and a work permit. You CAN move your sponsorship to your husband (in fact I advise this), however, your employer CAN still not give you an NOC which means that although you can remain the country, you can't get another job. (I know its a stupid rule). @Rehan, if you're visa is incorrect I recommend talking to your sponsor, there could be a good reason for it.

Thanks for your response - very much appreciated. Could you advise why you would suggest changing to my husband's sponsorship rather than maintaining my own? There are obviously benefits to this? If I do change sponsorship to my husband's, and then leave the country, can I then apply for another job? Or do I have to wait two years? Thanks again, Amnesia.

Because if you were fired and didn't get an NOC you would have to leave the country before being able to move over to your husband's sponsorship. If you are on his sponsorship and got fired and didn't get an NOC, then you can still stay in the country. Even if you are on his sponsorship and don't get an NOC, you still CANNOT get a job for 2 years without one, except you can be in the country.

hi, amnesia, have a nice day again. by the way regarding on our contract it was indicated in our salary offer that ALL OTHER EMPLOYMENT TERMS AND CONDITION ARE SUBJECT TO THE LABOR LAW OF QATAR. that was indicated on the employment offers, that means our employer must follow the law according to the labor law. is that correct? and if they avoid that kind of terms what the consecutive case will be file to the employer? because we dont have day off. no overtime pay... nothing. no increment........ because if they follow the rules they should follow the article 75 up to 81 or 85 like that. hope to understand the right of people ....... thanks......

Yes it does mean he must follow the labour law. In fact, even if it is NOT mentioned he must follow the labour law. No contract can negate a law. Companies that do not follow the law are fined.

Hi Amnesia, How are you? I've been reading your advises and it helps alot of people and i'm greatful to consult my problem also. I'm working w/ my company now for more than 3 years and I am locally hired here. My scenario was I'm not happy now w/ my company because of some reasons like Salary and how they treat their employees. I am now thinking to find a new job and will not renew my contract which will expire on Jan 2012. But they said if i do that, they will cancel me and ban me from entering Qatar for 2 years. Means my daughter here in Qatar will be cancelled too because she is under my sponsor. Now I'm scared and don't know what to do. Please help me to decide because I have reviewed my contract and it doesn't state there that they are giving NOC after finish contract. Thank you and God Bless You.

Amnesia, Employment Law question for you concerning remuneration - maybe you can advise. I have looked at the Labout law document and would refer you to clause 45 - my question refers to compensation for employees who are tasked with covering absence either through long term absence or through a genuine vacancy IN ADDITION to their own "regular" job - for example a Manager's role may be covered by his Supervisor for a number of months if the manager is ill through absence or has resigned. If there any clear guidance at Law concerning additional compensation or is it very much determined by the Policies and Procedures of individual companies?? Thanks

There is no law that highlights compensation, but if you are working out of your contracts requirements then you have the right to ask for compensation. However remember that if you make an employer angry they might not take it too well.

Hi Amnesia, I work as a Sales Advisor here in Doha, i have one question only. Do the locals here in Qatar have the Right to humiliate an Expat in front of many customers inspite of showing him politeness and treat her nicely?Because i just experenced it 3 days back when one Qatari Lady came back in store and returning what he purchase and wants her money back. I just told her in such cases we need an approval from Manager. And she started screaming, calling me Stupid, Idiot, no brain and other bad words in front of other Customer and she said. " This is my country, i can do whatever i want, " I feel ashame and humiliated. So what i did was to returned her money with my personal money just to stop her from humiliating me. In our country, we treat other nationalities with respect and hospitality. I just want to know our rights as expat workers when it comes to situation like this. Regards, BebS.
