Regarding NOC

NOC (no objection certificate), guess I am right.
Do I have right to ask / right to get, to the company to issue me an NOC after the current job/contract completes, provided the company does'nt have a suitable job for me based on my current job/qualification.

Please, amenesia hope you could guide me.

I am shocked to know the meaning of amnesia, is there an ARABIC meaning for amnesia ?

coming back to my query,
I mean to know that, do I have RIGHT TO GET the NOC as per Qatar's Labour rule from my current company when my current contract concludes. Hope I am straight to the point.
I heard many of the companies are not givieng NOC to the emplyees who are resigning / on contract completion.
My case would be the same shortly, I want to be prepared for that.

amnesia means when someone lost their memory.

Regarding your subject, yes my answer remains the same.
You have the right to request an NOC at any point in your contract, whether it is in the beginning or the end of your term.

Point is, some companies don't give an NOC and make an excuse as to why you don't deserve it, in which case, the solution is to appeal at the Human Rights authority or labour department.

hi amnesia,

I need your advice.. i finished my 2 years of contract last December 2010 & planning to go back to Qatar.
I requested NOC to my previous company and this the reply.

"As a policy, Company is not giving NOC to ex-employees before completing their statutorily required two years period from the date of departure. In your case, this period ends on 13th Dec 2012 and we cannot issue NOC prior to that date."

I hope you can advise me with my problem.

Dear Amnesia,

I have a problem here, please advise me.
My contract with the current company is completed due to the current company has no job suitable to my qualifications & all my settlements are paid, tommorrow is my flight back to my country.
I requested for an NOC from the current company so that I can come back if I get a job or I can try for a job before leaving Qatar.
The company says it cannot give in hand the NOC, only if I get a job they will release me in a proper channel.
But I came to know from friends, an NOC can be issued in hand before I can leave Qatar.

I want to know whether the company can issue an NOC in hand to me before I leave Qatar ? Do I have right to get NOC in hand before I leave Qatar without any job offer in hand.

Please advice me, tommorrow I should leave Qatar, I want to once again go to the company and request for an NOC.

Yes indeed, an NOC should be issued BEFORE.

The LEAST they should do is give you a letter that says that they will issue an NOC once you find a job.

1) Did they show you this new policy or give you access to the policy before you signed your contract and join the company?
If not, then you could have a case against them because this is NOT normal in Qatar.

2) It should be against the law (not sure if it is) to have such a policy. An NOC is not given to people who are a risk to the country.

3) What that person said DOESN'T make sense. They say they don't give an NOC until 2 years after you quit. BUT after two years, you don't NEED an NOC from them.

So I'm sorry but you should share with everyone the name of this messed up company that is messing with their employees.

No, i checked on my contract that there is no such thing as NOC company policy.
I will double check first everything & i will post the name of the company.

thanks amnesia for answering my previous query..the only sad part is that nothing happens in spite the fact that they ask for help in the labor dept..this company have so many connections ..they are what can I say " untouchable". i cannot divulge the name of the company for fear that the people working here will be threatened to resign even against their will.

there is one employee here..his contract was already done last november 2011..and yet until now he was still there..no plan yet as to when he will be sent home by this company..poor employee..he can't do anything. his salary for two months was given on a cash advance ,basis 1000 last month, this week 500..the remaining still questionable..

is there a lawyer out there who is really neutral who can help this poor people whatever nationality they are..who will help them pro bono...the employer is a lebanese..please if you could refer one thanks.

Dear Amnesia,

I have one question regarding NOC.
My offer letter mentioned that NOC will be given after 1 year but that is not mentioned in Contract.
Also In offer letter contract was yearly renewable but in contract it is of unlimited duration.
So now if i want to join Government from current private employer, is any way of getting NOC if employer denies (in future)?
My offer letter was sent on email to me on which base i came to qatar, so is offer letter has any value in Law (Mainly i am asking about getting NOC, which was mentioned in Offer letter but not in contract)?

Please do reply to guide me as i have little knowledge of this low OR Worker's ? Human's Rights in Qatar.

unlimited is good. Contract can be renewed yearly forever, of course you must both agree.

I think that the offer letter should be good enough to request an NOC.
If your employer denies it, then use the offer letter as evidence that you took the job because this is one of the things you were promised. The problem is that it was sent via email. All communication should be on letter head and signed.

Dear Amnesia,

I am also suffering from this case. My salary and facilities were not according to my job responsibilities and therefore I finally resigned from that company. I requested with my owner about NOC time to time but they denied to give it. Now, I am in my home country. Is there any chance to ask for NOC again from here?? Also, I have heard that the law is going to be changed very soon and we employees will not need NOC or we will not have any restriction to get back to Qatar. Is it???

you should complain to the ministry of labor.
Tell them to give you an NOC or you'll report them.

I have read through the various NOC related posts but can t see an answer to my particular query.

Would an NOC policy form part of my employment contract? i.e. if no mention of it is made is the witholding of an NOC contractually correct?

For example, when I joined the company NOC's were provided to all staff when they left the company and I signed my contract happily as I knew I would receive an NOC upon my resignation. Now the policy has changed and states that no staff will receive NOC's. So again, how does this stand contractually between the employer and their staff?

Any thoughts or advice appreciated.

Sadly a company can decide whether they give you an NOC or not. Some companies say it is 'against policy to issue NOC' but at the end of the day policy is not Law.

The NOC is supposed to be refused to people who are a threat to the country or to prohibit an employe for shifting to a competitor I imagine

I have been working in the same company since 2008 which is based in Dubai for 4 years now. Last Nov 2010 they shifted me to our Qatar Branch and after one year they shifted me back again here in UAE. My company cancelled my visa here in UAE before, so that they can apply for my visa in Qatar branch, then they re-apply again for my residency on UAE when my visa was expired in Qatar last Nov 2011. I'm on the 8th month now since I re-enter UAE (in my original company for 4 years).

Now, I got a very good offer in Qatar, but I am aware of the 2 year ban. Can I work there, considering Qatar was not my original post, I was just temporarily assigned there for 1 year and now I am back here in UAE where I was originally employed by the same company. Is the law applicable in my case, please advise what can I do in order to grab the offer there in Qatar? If I get NOC, is there a chance for me?..and who should issue the NOC for me, our Qatar Branch or UAE Branch.... Many thanks.....

Yes Ofcourse you have the right to ask NOC.

Similarly it is the discretion of the company to issue it or not.

Yes! Make sure you receive your NOC as soon as possible! They might hesitate to give you an NOC but as per Qatar Law, you have the right to receive your NOC at anytime of your employment. Be persuasive and push hard. They cannot refuse to give it to you. I hope this information helps.. Good luck
